Microsoft's 'intrusive' data collection in Windows 10 breaks Dutch privacy laws

As explained by Microsoft in its blog post, one of the key features of the Edge browser is its ability to create one continuous browsing experience for Windows 10 users across multiple devices.

The DPA issued a lengthy release about the matter, in which it is explained that there are almost 4 million active Windows 10 devices with Windows 10 Home and Pro in the Netherlands.

Now there are two options for telemetry data in Windows 10. The DPA is lead to believe that this telemetry data "take pictures" of the way Windows 10 users behave in the OS, creating an "intrusive profile". They are not informed which data are being used for what objective, neither that based on these data, personalized advertisements and recommendations can be presented, if those users have not opted out from these default settings on installation or afterward.

Microsoft is not the only tech company to draw on customer data for personalized advertising. She also goes on to state that just as Microsoft has worked with French and Swiss data protection agencies to tweak its Windows 10 telemetry settings to comply with local ordinances, it is also willing to work with the Dutch DPA.

I want our customers to know that it is a priority for us that Windows 10 Home and Windows 10 Pro are clearly compliant under Dutch law. Further, the agency claims that Microsoft makes it very hard for the users to approve their personal data for processing. Inkpad document contents can also be collected when full telemetry is enabled. Microsoft Edge will pull up the reading and information right onto your screen. On installation the telemetry level is set to full by default and the user is asked to accept the offered settings.

The app is in preview, which means that more features are on the way.

The Dutch Data Protection Authority (DPA) said on Friday that, after investigating Microsoft's Windows 10 Home and Pro operating systems - of which there are four million users in the Netherlands - it has concluded that the firm "does not clearly inform users about the type of data it uses, and for which purpose". Further, the company said that the Creators Update and upcoming Fall Creators Update will make it easier for the users to control their privacy options. However, the company made a similar promise past year to avoid being fined by the French DPA, too, so it remains to be seen if the changes Microsoft plans to make in a future Windows 10 update will indeed follow all of the law's requirements.
