Gaikwad hails 'No-Fly' rule for unruly passengers

The rules come weeks after Shiv Sena MP Ravindra Gaikwad beat up an elderly Air India employee after altercation over seat allocation.

Following the Air India slapping row in March, centre on Friday issued draft rules for the aviation sector on no-fly list.

Level two will include physically abusive behavior like pushing, kicking, and sexual harassment. The third category pertains to life threatening behaviour such as damage to aircraft operating system, physical violence such as choking or murderous assault and attempted breach of flight crew compartment.

Furthermore, under proposed law airlines can constitute a standing panel to look into complaints related to the unruly passenger. So finally for the first time in India, the Central Government drafted some rules for unruly passengers.

India has seen significant growth in domestic air traffic and infrastructure development, said the Minister for Civil Aviation, Ashok Gajapathi Raju while delivering the keynote address at the India Integrated Transport & Logistics Summit 2017. The list would be maintained by the Directorate General of Civil Aviation. He said, the Ministry has put draft rules on DGCA website for public comments and suggestions. The punishment for level 2 offences will be 6 months and that for level 3 offences will be 2 years or more of suspension. The punishment for level 2 offences will be six months and that for level 3 offences will be two years or more.

Speaking at the event where the announcement was made, Raju explained that the list was not mandatory for all airlines, but they could adopt it if they wanted.

Choubey explained that the proposal also provided an appeal provision for passengers. Passengers who have been suspended from flying can appeal against the decision.

"We will be identifying passengers on the basis of identity verification, either through an Aadhar card or passport".

We tried to strike the safety balance between passengers and airlines, said Sinha. However, Choubey said that this is still being examined.
